Hmm, it&#039;s all about the burden of proof - which probably requires some kind of video evidence or reliable witness. Without that, it&#039;s unfortunately hard to take it forward. That certainly would be one advantage of this proposed new Rule - if a driver hit a person cycling while passing then clearly they weren&#039;t maintaining a safe passing distance...]]></description>
